1. Introduction

Welcome to the History of Art Academy.

These Terms & Conditions ("Terms") govern all bookings, purchases and participation in courses, lectures, seminars, guided visits, educational walks, workshops, masterclasses and all other educational activities ("Courses") organised by the History of Art Academy ("the Academy", "we", "our" or "us").

By booking or participating in any Course, you acknowledge that you have read, understood and accepted these Terms.

These Terms are intended to provide a transparent framework for the relationship between the Academy and its participants while ensuring an enjoyable, respectful and intellectually enriching learning environment.

2. Definitions

For the purposes of these Terms:

Academy means the History of Art Academy.

Participant means any individual who books, purchases or attends a Course.

Course means every lecture, seminar, guided visit, workshop, educational walk, museum visit, gallery programme, masterclass, special event or any other educational service offered by the Academy.

Venue means any museum, gallery, church, historic building, cultural institution, hotel, café, public space, outdoor location or other site where a Course is conducted.

Website means the official website of the History of Art Academy and all associated booking pages.

3. Scope of Application

These Terms apply to all Courses offered by the Academy unless otherwise agreed in writing.

Courses may take place at one or more Venues and may include guided walks between locations as part of the educational programme.

The Academy reserves the right to offer Courses in various formats, including but not limited to:

  • museum-based courses;
  • gallery visits;
  • lectures;
  • seminars;
  • walking seminars;
  • architectural visits;
  • study programmes;
  • special exhibitions;
  • private courses;
  • bespoke educational programmes;
  • future online educational programmes.

Where additional conditions apply to a specific Course, these shall be communicated before booking and shall supplement these Terms.

4. About the History of Art Academy

The History of Art Academy provides independent educational programmes dedicated to the study and appreciation of the history of art, architecture, collecting, museums and visual culture.

The Academy's Courses are designed to encourage close observation, historical understanding and intellectual discussion through direct engagement with original works of art, architecture and cultural heritage.

Courses frequently take place in museums, galleries, churches, historic interiors and other culturally significant locations where original artworks may be studied in their historical and artistic context.

5. Eligibility

Participants must be at least eighteen (18) years of age unless otherwise stated.

Participants under the age of eighteen may attend only when accompanied by a parent or legal guardian or where written permission has been accepted by the Academy.

Participants are expected to conduct themselves respectfully towards fellow participants, museum staff, gallery personnel, venue staff and members of the public throughout the Course.

The Academy reserves the right to refuse participation or remove any participant whose behaviour is considered disruptive, inappropriate, unsafe or inconsistent with the educational purpose of the Course.

In such circumstances no refund shall be due.

6. Booking and Formation of Contract

Bookings may be made through the Academy's Website or through any booking method expressly authorised by the Academy.

A booking becomes legally binding once:

  • the booking has been accepted by the Academy;
  • payment has been received where payment is due immediately; and
  • a booking confirmation has been issued.

The Academy reserves the right to decline any booking at its reasonable discretion.

If a Course is fully booked, participants may be placed on a waiting list.

Should a place become available, participants on the waiting list will be contacted in the order in which they registered.

7. Course Fees and Payment

Course fees are published on the Website and are quoted in the applicable currency.

Prices may vary depending on the nature, duration and location of the Course.

Unless otherwise stated, full payment is required prior to the commencement of the Course.

The Course fee includes only those services expressly described in the Course description.

Unless specifically stated otherwise, the following are not included:

  • museum admission;
  • exhibition tickets;
  • transportation;
  • accommodation;
  • meals or refreshments;
  • personal expenses.

Participants are responsible for ensuring that all required admission tickets have been purchased where applicable.

8. Course Venues

Courses may be conducted at one or more locations including, but not limited to:

  • museums;
  • galleries;
  • churches;
  • historic houses;
  • palaces;
  • auction houses;
  • libraries;
  • cafés;
  • hotels;
  • universities;
  • cultural institutions;
  • public squares;
  • streets;
  • parks;
  • architectural sites; and
  • other places of artistic or historical significance.

Some Courses include walking between Venues.

Participants are responsible for arriving punctually at the designated meeting point.

The Academy cannot be responsible for missed parts of a Course resulting from late arrival.

9. Participant Responsibilities

Participants agree to behave in a respectful, courteous and considerate manner throughout every Course.

Participants shall comply with:

  • all instructions given by the Course instructor;
  • all regulations imposed by museums, galleries and other Venues;
  • applicable health and safety requirements;
  • photography restrictions imposed by individual Venues.

Participants shall not intentionally interfere with the enjoyment of the Course by others.

The Academy reserves the right to terminate a Participant's attendance without refund where their behaviour materially disrupts the Course or compromises the safety, comfort or enjoyment of others.

10. Health, Mobility and Accessibility

Many Courses involve standing for extended periods and walking between locations.

Participants are responsible for ensuring that they are physically able to participate comfortably.

Suitable footwear and weather-appropriate clothing are strongly recommended.

Participants requiring accessibility assistance are encouraged to contact the Academy before booking so that reasonable arrangements may be explored wherever possible.

While the Academy endeavours to select accessible Venues whenever practicable, accessibility may be limited by the historic nature of certain buildings and sites.

11. Cancellation by Participants

Participants may cancel their booking free of charge up to five (5) calendar days before the scheduled commencement of the Course.

For cancellations received fewer than five (5) calendar days before the Course begins, or in the event of non-attendance, the full Course fee remains payable and no refund shall be issued.

Cancellation requests must be submitted in writing by email to the Academy.

The date on which the cancellation is received by the Academy shall determine the applicable cancellation period.

Participants who are unable to attend may nominate another person to take their place without additional charge, provided that the Academy is informed prior to the commencement of the Course.

The substitute participant must satisfy any eligibility requirements applicable to the Course.

12. Cancellation or Changes by the Academy

The Academy reserves the right to cancel, postpone or reschedule a Course where this becomes reasonably necessary.

This may occur, for example, due to:

  • illness or unforeseen unavailability of the instructor;
  • insufficient participant numbers;
  • closure or restricted access to a museum, gallery or other Venue;
  • transport disruption;
  • severe weather conditions;
  • public safety considerations;
  • force majeure; or
  • any other circumstance beyond the Academy's reasonable control.

Where reasonably possible, participants shall be notified without undue delay.

In the event of cancellation by the Academy, participants may choose between:

  • a full refund of all Course fees paid; or
  • transfer to another available Course of equivalent value; or
  • a credit towards a future Course.

Except where required by law, the Academy shall not be responsible for any consequential costs incurred by participants, including travel, accommodation or other personal expenses.

13. Programme Changes

The Academy strives to deliver every Course substantially as described.

However, the Academy reserves the right to make reasonable modifications where necessary.

Such modifications may include:

  • changes to the itinerary;
  • changes to the sequence of visits;
  • replacement of individual artworks or exhibitions;
  • substitution of venues;
  • changes to instructors;
  • minor timetable adjustments.

Museums and galleries frequently rotate collections, loan works of art to other institutions or temporarily close individual galleries.

Accordingly, the Academy cannot guarantee that any particular artwork, exhibition, gallery or object will always be available for viewing.

Such changes shall not constitute grounds for cancellation or refund provided that the overall educational objectives of the Course remain substantially unchanged.

14. Museums, Galleries and External Venues

Many Courses are conducted in collaboration with museums, galleries and other independent cultural institutions.

Participants agree to comply at all times with the regulations, admission requirements and visitor policies of each Venue.

These may include restrictions concerning:

  • photography;
  • filming;
  • sketching;
  • food and beverages;
  • luggage;
  • mobile phones;
  • access to particular galleries.

Failure to comply with the rules of a Venue may result in removal from the Venue and, where appropriate, from the remainder of the Course.

The Academy accepts no responsibility for decisions taken independently by any Venue.

15. Walking Between Venues

Certain Courses include walking between museums, galleries or other locations as an essential part of the educational programme.

Participants acknowledge that these walks may take place in urban environments, public streets, parks or pedestrian areas.

Each participant remains responsible for exercising reasonable care and observing all applicable traffic regulations throughout the walk.

Participants should ensure that they wear suitable footwear and clothing appropriate to the weather conditions.

16. Photography, Audio and Video Recording

Participants may take photographs only where permitted by the relevant Venue.

The Academy is not responsible for restrictions imposed by museums, galleries or other institutions regarding photography or recording.

Photography, filming or recording of lectures, presentations or Course materials for commercial purposes is prohibited unless prior written permission has been obtained from the Academy.

The Academy may occasionally photograph or record Courses for educational, promotional or archival purposes.

Where participants are identifiable in such material, the Academy shall process any personal data in accordance with its Privacy Policy.

Participants who prefer not to appear in photographs are kindly requested to notify the Academy before the Course commences.

17. Intellectual Property

All Course materials, lectures, presentations, educational content, written texts, illustrations, designs and teaching resources remain the intellectual property of the History of Art Academy or their respective copyright holders.

Participation in a Course does not confer any ownership rights in such materials.

Course materials are provided solely for the personal educational use of participants.

Except where expressly permitted by law, no Course materials may be copied, reproduced, distributed, published, translated, adapted or used for commercial purposes without the Academy's prior written consent.

18. Participant Conduct

The Academy seeks to foster an atmosphere of intellectual curiosity, respectful dialogue and mutual consideration.

Participants are expected to contribute positively to the learning environment.

The Academy reserves the right to refuse admission or terminate participation where conduct is considered:

  • abusive;
  • discriminatory;
  • threatening;
  • disruptive;
  • unlawful; or
  • incompatible with the educational character of the Course.

In such circumstances, no refund shall be payable.

19. Liability

The Academy undertakes to organise its Courses with reasonable skill and care.

Participation in all Courses is voluntary and undertaken at the participant's own responsibility.

To the fullest extent permitted by applicable law, the Academy shall not be liable for:

  • loss, theft or damage to personal belongings;
  • travel delays;
  • missed connections;
  • closure of museums or galleries;
  • changes made by third-party institutions;
  • weather-related interruptions;
  • indirect or consequential loss.

Nothing in these Terms shall exclude or limit liability for death or personal injury caused by negligence, fraud or any liability that cannot lawfully be excluded under applicable law.

20. Force Majeure

The Academy shall not be liable for any delay, interruption, modification or cancellation resulting from events beyond its reasonable control.

Such events include, but are not limited to:

  • natural disasters;
  • extreme weather;
  • fire;
  • flood;
  • pandemics;
  • epidemics;
  • governmental restrictions;
  • industrial action;
  • civil disturbance;
  • terrorism;
  • war;
  • transport disruption;
  • closure of museums or cultural institutions; or
  • any comparable event beyond the Academy's reasonable control.

Where practicable, the Academy shall use reasonable efforts to arrange an alternative date or suitable substitute programme.

21. Health, Safety and Medical Emergencies

The Academy is committed to providing a safe, welcoming and enjoyable learning environment for all participants.

Many Courses involve extended periods of standing, walking through museums, galleries, historic buildings or public spaces, and may include stairs, uneven surfaces or other features typical of historic architecture.

Participants are responsible for assessing their own health and physical ability before booking a Course.

Participants should wear appropriate clothing and comfortable footwear suitable for the nature of the Course and prevailing weather conditions.

The Academy should be informed in advance of any significant accessibility requirements or medical conditions that may reasonably affect participation.

While every reasonable effort will be made to accommodate participants where practicable, the Academy cannot guarantee that every historic venue or external location will be fully accessible.

In the event of illness, injury or another medical emergency during a Course, the Academy may, where reasonably necessary, arrange appropriate assistance or contact the emergency services.

The Academy shall not be responsible for medical expenses or any costs arising from such assistance except where liability cannot lawfully be excluded.

22. Code of Conduct

The History of Art Academy is founded upon the principles of intellectual curiosity, respectful dialogue and appreciation of cultural heritage.

Participants are expected to contribute positively to the learning experience by behaving with courtesy and consideration towards:

  • fellow participants;
  • instructors;
  • museum, gallery and venue staff;
  • members of the public;
  • works of art, historic buildings and cultural property.

Participants shall not engage in behaviour that is abusive, discriminatory, intimidating, disruptive or otherwise inconsistent with the educational character of the Academy.

Participants shall comply with all rules established by museums, galleries and other venues, including those relating to photography, security, conservation and visitor conduct.

The Academy reserves the right to refuse admission or remove any participant whose conduct materially interferes with the educational experience or compromises the safety, dignity or enjoyment of others.

Where a participant is removed from a Course for reasons of misconduct, no refund shall be payable.

23. Educational Visits, Study Tours and Future Programmes

From time to time, the Academy may organise educational visits, study tours, international programmes or other special events extending beyond its regular Courses.

Additional terms may apply to such programmes where appropriate.

Unless expressly stated otherwise, these Terms & Conditions shall also govern participation in such educational activities.

Participants remain responsible for obtaining all documentation, visas, travel insurance and any other requirements necessary for participation in programmes taking place outside their country of residence.

Where accommodation, transportation or other travel services are arranged by independent providers, such services shall remain subject to the terms and conditions of those providers.

The Academy shall not be responsible for acts or omissions of independent travel providers except where liability cannot lawfully be excluded.

The Academy reserves the right to modify itineraries where reasonably necessary due to museum closures, transport disruption, weather conditions, governmental requirements or other circumstances beyond its reasonable control, while endeavouring to preserve the educational objectives of the programme.

24. Privacy and Personal Data

The Academy is committed to protecting the privacy and personal information of its participants.

Personal data is collected and processed only where necessary for the administration of bookings, the delivery of Courses, communication with participants and compliance with applicable legal obligations.

The Academy processes personal data in accordance with the General Data Protection Regulation (EU) 2016/679 (GDPR) and all applicable Austrian data protection legislation.

Further information regarding the collection, processing and protection of personal data is available in the Academy's separate Privacy Policy, which forms an integral part of the Academy's legal information.

25. Website Content

The Academy endeavours to ensure that all information published on its Website is accurate and up to date.

However, descriptions of Courses, schedules, venues, artworks, exhibitions and instructors may occasionally require amendment.

The Academy reserves the right to correct typographical errors, inaccuracies or omissions and to update information at any time without prior notice.

Images published on the Website are intended to illustrate the general nature of the Academy's educational programmes and do not necessarily represent the exact content of a particular Course.

26. Consumer Rights

Nothing contained in these Terms shall limit or exclude any mandatory rights granted to consumers under applicable Austrian or European Union law.

Where any provision of these Terms conflicts with mandatory consumer protection legislation, the relevant statutory provisions shall prevail.

27. Communications

By making a booking, participants agree that the Academy may contact them regarding:

  • booking confirmations;
  • payment information;
  • Course updates;
  • practical information relating to the Course;
  • changes of venue or schedule;
  • cancellations;
  • important administrative communications.

Participants may also choose to subscribe separately to newsletters or other marketing communications.

Marketing communications shall only be sent where the participant has given the required consent or where otherwise permitted by applicable law.

Participants may unsubscribe from marketing communications at any time.

28. Third-Party Venues

The Academy collaborates with museums, galleries, libraries, cultural institutions, hotels and other organisations in order to provide its educational programmes.

Unless expressly stated otherwise, these organisations are independent entities and are not responsible for the organisation or operation of the Academy's Courses.

The Academy cannot accept responsibility for decisions made independently by third-party venues, including changes to opening hours, admission policies, gallery closures or visitor regulations.

29. Future Educational Services

The Academy may from time to time expand its educational activities to include additional services, including but not limited to:

  • online courses;
  • live-streamed lectures;
  • recorded educational content;
  • study trips;
  • educational travel programmes;
  • memberships;
  • private tuition;
  • bespoke educational events;
  • corporate programmes;
  • publications.

Unless otherwise stated, these Terms shall also apply to such services, together with any supplementary conditions specific to the relevant programme.

30. Intellectual Integrity

The Academy is committed to the highest standards of academic integrity and intellectual honesty.

Participants are expected to respect the educational environment by engaging constructively in discussion and by acknowledging the intellectual property rights of the Academy, instructors, museums and other contributors.

The Academy reserves the right to protect its educational content against unauthorised reproduction or misuse.

31. Amendments to these Terms

The Academy reserves the right to amend these Terms from time to time where reasonably necessary.

The most current version shall always be published on the Academy's Website.

Any amendments shall apply only to future bookings unless otherwise required by law.

32. Severability

If any provision of these Terms is held by a competent court or authority to be invalid, unlawful or unenforceable, the remaining provisions shall remain in full force and effect.

Any invalid provision shall, where possible, be interpreted in a manner that most closely reflects its original purpose while remaining legally enforceable.

33. Entire Agreement

These Terms constitute the entire agreement between the Academy and the Participant concerning the booking and participation in Courses.

They supersede all previous communications, understandings or agreements relating to the same subject matter.

No oral statements or representations shall modify these Terms unless confirmed in writing by the Academy.

34. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Republic of Austria.

Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts in Vienna, Austria, unless mandatory consumer protection legislation provides otherwise.
